License Revocation

Since you are facing a second DUI conviction, the process for getting back on the road is much more rigorous than the first time. Florida categorizes second-time offenders as "Multiple Offenders," which triggers a mandatory "hard time" waiting period and specialized supervision.

1. Hardship License Eligibility (5-Year Revocation)

If your second DUI was within 5 years of the first, your license is revoked for 5 years. You cannot simply "waive" your way into a hardship license like a first-timer.

  • The 1-Year "Hard Time": You are legally ineligible for any driving permit for the first 12 months of your 5-year revocation.

  • The Application Process: After that first year is up, you can apply for a hardship license (Business Purposes Only) at a Bureau of Administrative Reviews (BAR) office.

  • Special Supervision Services (SSS): This is the biggest hurdle. You must register for "DUI Special Supervision." This involves:

    • Monthly check-ins with a DUI program.

    • Random drug/alcohol testing.

    • Continuous clinical evaluation to ensure you are remaining sober.

    • Note: If you are caught with any alcohol or drugs in your system while under SSS, your hardship license is permanently cancelled.

2. Level 2 DUI Schools

For a second DUI, you are required to take Level 2 DUI School (21 hours). You cannot take Level 1 again. Below are the primary providers where you can register:

Region School Name Phone Website
Tampa / Hillsborough DUI Counterattack (813) 875-6201 tampadui.com
Miami-Dade Advocate Program (305) 704-0200 advocateprogram.org
Orlando / Central FL Florida Safety Council (407) 897-4454 floridasafety.org
Jacksonville / NE FL NE FL Safety Council (904) 399-3119 nefsc.org
Clearwater / Pinellas Suncoast Safety Council (727) 373-7233 safety.org
Ft. Lauderdale / Broward Broward Dade Safety (954) 763-4505 browardsafety.org
Ft. Myers / SW FL SW FL Safety Council (239) 332-3008 swflsc.com

3. Mandatory Requirements for Reinstatement

Before the BAR will even grant you a hearing for a hardship license, you must prove:

  1. Completion of Level 2 DUI School: You must have the certificate in hand.

  2. Substance Abuse Treatment: If the DUI school evaluation recommended treatment (which is almost certain for a second offense), you must be actively participating or have completed it.

  3. Ignition Interlock Device (IID): You must have an IID installed in your vehicle for at least 1 year (2 years if your BAC was .15 or higher).

  4. FR-44 Insurance: You must show proof of the high-limit "DUI Insurance" ($100k/$300k).

The Cost Factor

Registering for Level 2 DUI school typically costs between $530 and $560 in Florida. This is significantly higher than Level 1 due to the extra hours and clinical supervision required.
