Fourth DUI Penalties

In Florida, a fourth DUI conviction is the "end of the line" for driving privileges. It is automatically classified as a third-degree felony, regardless of how much time has passed since your previous convictions.

The state views a fourth offense as a habitual threat to public safety, and the penalties reflect that.


1. Criminal Penalties (Third-Degree Felony)

Because it is a felony, you are facing circuit court and a possible sentence in Florida State Prison, not just county jail.

  • Prison Time: Up to 5 years in state prison.

  • Fines: Minimum $2,000; maximum $5,000. (Minimum $4,000 if BAC was .15+).

  • Probation: Up to 5 years (often as a combination of prison and "split" probation).

  • Felony Record: You will lose the right to vote, possess a firearm, and hold many professional licenses.

2. Driver's License: Permanent Revocation

This is the most severe administrative penalty in Florida.

  • The Rule: Upon a fourth conviction, the court and the DHSMV will permanently revoke your driver's license for life.

  • Out-of-State Convictions: Florida counts DUI convictions from other states. If you have three priors in Georgia and get one in Florida, it counts as your fourth.


3. Is there any way to drive again? (Hardship Exception)

While the revocation is called "permanent," Florida law ($322.271, F.S.) provides a very narrow path to a hardship license, but only after a long wait.

The 5-Year "Hard Time"

You must wait at least 5 years from the date of your last conviction (or 5 years from your release from prison, whichever is later) before you can even petition for a hearing.

Requirements for a 4th-Time Hardship:

  1. 5 Years of "Clean" Living: You must prove you have not driven a vehicle and have remained completely alcohol and drug-free for the 5 years prior to your hearing.

  2. DUI Special Supervision (SSS): You must enroll in the Special Supervision Services program, which involves monthly check-ins and random drug testing for the rest of your life.

  3. Level 2 DUI School: Completion of the 21-hour course and all recommended clinical treatment.

  4. Ignition Interlock Device (IID): Mandatory installation for at least 2 years on any vehicle you drive.

  5. FR-44 Insurance: You must maintain high-limit "DUI Insurance" ($100k/$300k).

Warning: If you are granted this hardship license and ever miss a supervision meeting or test positive for alcohol/drugs, your license is cancelled forever with no further chances for appeal.


4. Vehicle Impoundment

For a fourth DUI, the court must order the impoundment or immobilization of all vehicles you own for 90 days. This cannot overlap with your time in prison.
